• Baby Names AI & NameWise mobile applications do not collect any personal information of any kind. User email or personal information are not required in order to use the application. 

• All user settings used for names generations and favorite names ( names you like ) are stored on the mobile device itself and they are not visible to us. 

• Baby Names AI & NameWise applications use OpenAI.com to generate context based on user settings and input, without collecting any personal data from the user. • Baby Names AI & NameWise applications use Google AdMob advertisement services to serve ads within the application. Google Ads may use cookies, web beacons, or other technologies to collect information about your use of the App and other websites to provide you with targeted advertising based on your interests. The Baby Names AI & NameWise applications may give you access to links through adverts to third-party websites, apps, or other products or services ("Third Party Services"). Baby Names AI does not control Third Party Services in any manner and, accordingly, does not assume any liability associated with such Third Party Services. You need to take appropriate steps to determine whether accessing a Third Party Service is appropriate, and to protect your personal information and privacy in using any such Third Party Services. 

More information

In some cases we use the anonymized data to gather statistics of popular names, make suggestions etc. These actions and data can not be traced down to your user. Suggestions are also handled anonymously.

Terms and Conditions: END-USER LICENSE AGREEMENT

These Terms of Use (this "Agreement") is a legal agreement between you ("you") and NuvolariApps, for use of the Baby Names AI and/or NameWise mobile application, the website, the servers used by the application, the computer files stored on such servers, and all related services, features and content offered by NuvolariApps.

Acceptance of terms

Please read this Agreement carefully. By accessing or using the App, you acknowledge that you accept and agree to be bound by the terms of this Agreement. IF YOU DO NOT AGREE TO THESE TERMS, If you do not agree to the terms of this Agreement, do not install, download, access or use the App.

We may modify this Agreement from time to time. We will notify you by email, through the App, or by presenting you with a new version of the Agreement for you to accept if we make modifications that materially change your rights. Your continued use of the App after the effective date of an updated version of the Agreement will indicate your acceptance of the Agreement as modified.

License

NuvolariApps grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

Changes to the App

From time to time and without prior notice to you, we may change, expand and improve the App. We may also, at any time, cease to continue operating part or all of the App or selectively disable certain features of the App. Your use of the App does not entitle you to the continued provision or availability of the App. Any modification or elimination of the App or any particular features will be done in our sole and absolute discretion and without an ongoing obligation or liability to you.

Third Party Services

The App may give you access to links to third-party websites, apps, or other products or services ("Third Party Services"). Baby Names AI does not control Third Party Services in any manner and, accordingly, does not assume any liability associated with such Third Party Services. You need to take appropriate steps to determine whether accessing a Third Party Service is appropriate, and to protect your personal information and privacy in using any such Third Party Services.

Restrictions

 You agree not to, and you will not permit others to:

 a) License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the App or make the App available to any third party.

 b) Modify, make derivative works of, disassemble, reverse engineer or otherwise attempt to discover any source code or algorithms of the App.

 c) Remove or alter any proprietary notices or labels on or in the App.

Intellectual Property

The App and all worldwide copyrights, trade secrets, and other intellectual property rights therein are the exclusive property of NuvolariApps and its licensors. The structure, organization and code of the App are the valuable trade secrets and confidential information of NuvolariApps  and its licensors. You agree not to access or attempt to access the App by any means other than through the interface that is provided by NuvolariApps.

Termination 

This Agreement is effective until terminated by you or NuvolariApps. Your rights under this Agreement will terminate automatically without notice from NuvolariApps if you fail to comply with any term(s) of this Agreement. Upon the termination of this Agreement, you shall cease all use of the App and destroy all copies, full or partial, of the App.

Warranty disclaimer

NuvolariApps controls and operates the App from various locations and makes no representation that the App is appropriate or available for use in all locations. The App or certain features of it may not be available in your location or may vary across locations. THE APP IS PROVIDED "AS IS", "AS AVAILABLE" AND IS PROVIDED WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED, SAVE TO THE EXTENT REQUIRED BY LAW. Baby Names AI, AND ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS, PARTNERS AND CONTENT PROVIDERS DO NOT WARRANT THAT: (A) THE APP WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE APP WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE APP IS SOLELY AT YOUR OWN RISK. SOME STATES / COUNTRIES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NUVOLARIAPPS OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE APPLICATION OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF NUVOLARIAPPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

Indemnification

You hereby indemnify NuvolariApps and its officers, directors, employees, agents and affiliates against any and all losses, damages, costs, liabilities and expenses (including reasonable legal fees) suffered or incurred by NuvolariApps  in connection with any breach by you of this Agreement.

Governing Law

This Agreement is governed by the laws of Italy.
